According to Congressional staff, the House of Representatives will vote as early as next week to extend the IRA Charitable Rollover for one year, through the end of 2010. Unless Congress acts soon, the IRA Charitable Rollover, which allows individuals age 70 and older to make outright charitable donations of up to $100,000 from IRAs and Roth IRAs without having to count the distributions as taxable income, will expire on December 31st. The House legislation is also expected to include several other "extender" provisions that will benefit charitable giving, including provisions related to: contributions of capital gain real property for conservation purposes; enhanced charitable deduction for contributions of food, book inventories to public schools, and corporate contributions of computer equipment for educational purposes; special tax treatment of certain payments to controlling exempt organizations; and special rules for S corporations making charitable contributions of property.
